Job platform for refugees

SEEK REFUGEE SERVICES CIC TERMS AND CONDITIONS

Introduction

1.1           These terms and conditions shall govern your use of our website, www.seekuk.org and its associated applications (together, the “Platform”).

1.2          The term “we” means Seek Refugee Services CIC, the owner and operator of the Platform, whose registered office is at 27C Swan Street, London, England, SE1 1BY and whose company registration number is 11114334 (“us” and “our” will be construed accordingly).

1.3          The term “you” refers to the individual organisation registered with the Platform (and “your” will be construed accordingly). We use the term “Recruiter” in these terms and conditions to refer to those organisations seeking candidates who are registered on our Platform.

1.4           By using our Platform or continuing to browse our website, you agree to accept these terms and conditions. If you disagree with any of these terms and conditions, you must not use the Platform.

1.5           Our Platform uses cookies. By using our Platform, you consent to our use of cookies in accordance with the terms of our privacy and cookies policy at https://seekuk.org/cookie-policy.

Use on behalf of an organisation

2.1           If you are employed by a company or other organisation, by registering with the Platform you warrant that you are authorised by the organisation in which you represent to use the Platform and to bind that organisation to these terms and conditions and in these circumstances references to “you” in these terms and conditions are to both the individual user and the relevant organisation or legal entity.

Registration and Subscription Fees

3.1           You may register with our Platform by completing and submitting the recruiter account registration form on our Platform.

3.2          We may update our Job-Posting Fees from time to time. Any changes to the Job-Posting Fee will be posted on the Platform and will take effect only once the Recruiter purchases a new package.

Using the Platform

4.1           The Seek Platform is designed to enable Recruiters to submit job descriptions for candidates (“Job Descriptions”) to fill vacancies within their organisations (a “Job”) to the Platform. We send those Job Requests to registered our partner organisations who will then be given the opportunity to offer suitable candidates to that Recruiter. Candidates that have registered with the Platform are able to view a Job and apply.

4.2           Once you have received Contact Details you are free to contact the candidate. We charge a fee per person placed in an organisation (a “Recruitment Fee”). More details about the Recruitment Fee can be found on https://www.seekuk.org/fees.

4.3           You understand and agree that we have not independently verified the accuracy of any Jobs posted through the Platform and do not make any representations or warranties in respect of such postings. We do not issue any refunds of Credits in the event of any errors or inaccuracies found in a Job posting.

Credits

5.1           Agents will be required to purchase Credits if they wish to receive Contact Details. The number of Credits required to purchase Contact Details will vary according to the Recruitment Fee payable in respect of the Job. Full details will be set out on the Platform.

Our role

6.1           We act as an introducer, introducing candidates to Recruiters. None of the Agents or Recruiters registered on our Platform are employed by Seek Refugee Services CIC.

6.2           You agree that, unless otherwise stated in these terms, we have no liability to you in relation to any candidates you choose to hire through the Platform.

6.3           You acknowledge that we are not party to any contract for the provision of services which you may make with candidates found through this Platform and accordingly we are not responsible for the enforcement of any contractual obligations arising out of a contract for the provision of services and we will have no obligation to mediate between the parties in the event of any dispute.

User login details

7.1           When you register as a Recruiter with our Platform, you will be given a User Account and an Organisation Account. You may invite others from within your organisation to set up additional User Accounts within the Organisation Account.

7.2           You will be asked to choose passwords for each account.

7.3           You must keep password confidential and not allow your accounts to be used by anyone other than the registered users within your organisation.

7.4           You are responsible for any activity on our Platform arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

Cancellation and suspension of account

8.1           We reserve the right to suspend or cancel your account at any time if we believe that you are in breach of any of the terms of use. In such event, you will not be entitled to any refund.

Limitations and exclusions of liability

9.1           To the maximum extent permitted by applicable law and subject to clause 9.2, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our Platform and the use of our Platform.

9.2          Nothing in these terms and conditions will limit or exclude any liability for death or personal injury resulting from our negligence or any liabilities that are not permitted to be limited under applicable law.

9.3           The limitations and exclusions of liability set out in this clause 9 and elsewhere in these terms and conditions govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

9.4           We will not be liable to you in respect of any special, indirect or consequential loss or damage, any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

9.5           We are not obligated to send you details of any Job posted on the Platform or to provide you with Contact Details of any candidate.

9.6           In the event that any limitation or exclusion of liability in these terms is not enforceable, then we shall not be liable to you for more than the amount of your Job-Posting Fees and Recruitment Fees.

9.7        We make no warranty that the Seek Refugee Services Platform will provide an uninterrupted service or be error free, or that any defects will be corrected.  While we take steps to prevent misuse of our systems, we cannot warrant that the Seek Refugee Services Platform will be free of viruses or other malicious code and accept no liability for loss or damage caused from the transmission of such code.  We recommend that you always use up-to-date firewalls and anti-malware software to protect your equipment and data.

General Terms

10.1        If any of the Terms are held to be illegal or unenforceable, such provisions shall be severed and the rest of the Terms shall remain in full force and effect.

10.2        The Terms constitute the entire agreement and replace any previous agreement or understanding (whether oral or written, express or implied) between us in respect of the matters contained or referred to in the Terms.  Each of us agree that, in entering the Terms, we have not relied on and have no remedy in respect of, any representation, warranty or other provision (oral or written, express or implied) of any person which is not expressly set out in the Terms.   The only remedy available in respect of any misrepresentation or untrue statement shall be a claim for breach of contract under the Terms.  This paragraph does not operate to limit or exclude any liability arising from any fraudulent or dishonest statement, act or omission.

10.3        You may not assign, transfer or sub-contract any of your rights under the Terms without our prior written consent.  We may assign, transfer or sub-contract all or any of our rights at any time without consent.

10.4        A person who is not a party to the Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision in the Terms.

10.5        No waiver by either of us shall be effective unless in writing, and no waiver shall constitute a continuing waiver so as to prevent us or you from acting upon any continuing or subsequent breach or default.

10.6        We may revise these terms and conditions from time to time. The revised terms and conditions shall apply to the use of our Platform from the date of publication of the revised terms and conditions on the Platform, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. If you do not agree to the revised terms and conditions, you must stop using our Platform.

10.7        The Terms shall be subject to the laws of England and the parties shall submit to the exclusive jurisdiction of the English courts.

 

CANDIDATE TERMS AND CONDITIONS

Seek Refugee Services Platform

1.1           These terms and conditions shall govern your use of our website, www.seekuk.org and its associated applications (together, the “Platform”).

1.3           In these Terms, you will be referred to as “you” or the “Candidate”.

1.4           By using our Platform or continuing to browse our website, you agree to accept these terms and conditions. If you disagree with any of these terms and conditions, you must not use the Platform.

1.5           Our Platform uses cookies. By using our Platform, you consent to our use of cookies in accordance with the terms of our privacy and cookies policy at www.seekuk.org/cookie-policy.

1.4           We may vary the Terms from time to time and shall post such alterations on the Platform.  If you do not agree to the changes made to the Terms, then you have the right to stop using the RecruitMyJob.com Platform, and should do so immediately.  Your continued use of the RecruitMyJob.com Platform after the date the changes have been posted will constitute acceptance of the amended Terms.

1.5           You may register for a Candidate’s account with our Platform by completing and submitting the account registration form on our Platform.

 

Requests for Recruitment Services

3.1           The Seek Refugee Services CIC Platform is designed to enable Recruiters to submit job descriptions for candidates (“Job Descriptions”) to fill vacancies within their organisations (a “Job”) to the Platform. We send those Job Requests to partner organisations who will then be given the opportunity to offer suitable candidates to the Recruiter. Candidates are able to view Jobs and apply.

3.2           Agents that receive your Contact Details are free to contact you and to enter into any arrangement or agreement at your discretion.

3.3           You warrant that all information you provide whether on the Platform or direct to recruitment agents registered on our Platform (“Agents”) will be true and fair and not misleading. We reserve the right to remove any Candidate from the Seek Refugee Services CIC Platform if they repeatedly fail to provide accurate details of any Job.

 

Candidate fees

4.1           We do not charge any subscription fee or other payment to Candidates to register with us or to apply for Jobs on the platform.

 

Cancellation

5.1           If you wish to cancel your registration with Seek Refugee Services CIC, you can do so at any time through your dashboard page on the Platform or over email.

 

User login details

6.1           When you register with our Platform, you will be asked to choose a password for your account.

6.2           You must keep password confidential and not allow your accounts to be used by anyone other than the registered users within your organisation.

6.3           You are responsible for any activity on our Platform arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

 

Disclaimers

7.1           We are not obligated to make available the Seek Refugee Services CIC Platform services to you and we reserve the right to remove you from the Seek Refugee Services CIC Platform at any time and for any reason at our discretion.

7.2           We are not obligated to post any Jobs for you on the Platform and you are not obligated to enter into any agreements with Recruiters who may contact you through the Platform.

7.4           We make no warranty as to the Recruiters we refer to you and are not liable for any loss or damage you may incur as a result of an introduction to a Recruiter.

7.5           Seek Refugee Services CIC acts as an introducer and is not a party to any contract made between you and the Recruiter. You will be responsible for all legal and regulatory requirements relevant to your contract with your Recruiter.

 

Limitation of Liability

8.1           Nothing in the Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

8.2           If you are dissatisfied with the Seek Refugee Services CIC Platform, or the Terms, your remedy under the Terms shall be to discontinue your use of the Seek Refugee Services CIC Platform.

8.3           Other than as set out above, we shall not be liable in contract, tort, negligence, statutory duty, misrepresentation, or otherwise for any loss or damage whatsoever arising from or in any way connected with the Terms or your use of the Seek Refugee Services CIC Platform.

8.4           Except as expressly set out in the Terms, all conditions, warranties and obligations which may be implied or incorporated into the Terms by statute, common law, or otherwise and any liabilities arising from them are expressly excluded to the extent permitted by law.

8.5           We shall not be liable for any loss of business, loss of profits, business interruption, loss of business information, or any other economic loss.

8.6           In the event that any limitation or exclusion of liability in the Terms is not enforceable, then we shall not be liable to you for more than £50 in aggregate in respect of all matters concerning or arising out of your use of the Seek Refugee Services CIC Platform.

 

General Terms

9.3           We reserve the right at all times to edit, refuse to post, or to remove from the Seek Refugee Services CIC Platform any information or materials for any reason whatsoever, and to disclose any information we deem appropriate to satisfy any obligation we may have under applicable laws, regulatory requirements, legal processes, or to satisfy any request of the police, government or any regulatory body.

9.4           You may not assign, transfer or sub-contract any of your rights under the Terms without our prior written consent.  We may assign, transfer or sub-contract all or any of our rights at any time without consent.

9.5           A person who is not a party to the Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision in the Terms.

9.6           No waiver by either of us shall be effective unless in writing, and no waiver shall constitute a continuing waiver so as to prevent us or you from acting upon any continuing or subsequent breach or default.

9.7           We may revise these terms and conditions from time to time. The revised terms and conditions shall apply to the use of our Platform from the date of publication of the revised terms and conditions on the Platform, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. If you do not agree to the revised terms and conditions, you must stop using our Platform.

9.8           The Terms shall be subject to the laws of England and the parties shall submit to the exclusive jurisdiction of the English courts.

Data handling

Trading and sharing personal information: Personal information is traded and shared as a primary business function. For this reason, the information processed may include name, contact details, employment details and goods and services. This information may be about customers and clients. The information may be traded or shared with business associates and professional advisers, agents, service providers and customers and clients.

Consulting and advisory services: Information is processed for consultancy and advisory services that are offered. For this reason the information processed may include name, contact details and the goods and services provided. This information may be about customers and clients. Where necessary this information is shared with the data subject themselves, business associates and other professional advisers, current, past or prospective employers and service providers.

Transfers: It may sometimes be necessary to transfer personal information overseas. When this is needed information is only shared within the European Economic Area (EEA). Any transfers made will be in full compliance with all aspects of the EU General Data Protection Regulation.
